BNY Mellon yesterday lost a bid to have a lawsuit dismissed on behalf of securities lending clients who allegedly lost more than $1 billion because the bank invested their collateral in notes issued by Lehman Brothers.

In Manhattan, U.S. District Judge Richard Sullivan refused to dismiss a breach of contract claim against the custodian, whose clients allege they were not protected against investments made in Lehmans floating rate notes.
